1. Acceptance

By creating an account or using Preshift (“Service”), you agree to these Terms. If you do not agree, do not use the Service. These Terms apply to all users, including restaurant operators, managers, and any other individuals who access the Service.

2. Description of Service

Preshift is a shift operations platform for restaurants. It allows managers to log shift notes, track open issues, and share structured handoffs with incoming managers. The Service uses AI to structure shift notes and detect recurring operational issues.

3. Accounts

You must provide a valid email address to create an account. You are responsible for all activity that occurs under your account. You must notify us immediately at info@preshift.me if you believe your account has been compromised.

4. Subscriptions and Billing

Preshift offers paid subscription plans billed monthly or annually. All plans include a 14-day free trial. After the trial period, a valid payment method is required to continue using the Service.

Subscriptions renew automatically unless cancelled before the renewal date.
You may cancel at any time from your billing settings. Cancellation takes effect at the end of the current billing period.
We do not provide refunds for partial billing periods.
Prices may change with 30 days' notice. Changes apply at your next renewal.

5. Acceptable Use

You agree not to:

Use the Service for any unlawful purpose
Attempt to gain unauthorized access to any part of the Service or its infrastructure
Scrape, crawl, or data-mine the Service without written permission
Upload content that is defamatory, harassing, or that infringes third-party rights
Resell or sublicense the Service without written permission

6. Your Data

You retain ownership of all data you submit to the Service, including shift notes, task descriptions, and location information. By submitting data, you grant Preshift a limited license to store, process, and display that data solely to provide the Service to you.

7. AI Processing

The Service uses AI (including Anthropic’s Claude) to structure and categorize shift notes. AI output is provided for operational convenience and may not always be accurate. You are responsible for reviewing structured tasks before acting on them. Preshift is not liable for operational decisions made based on AI-generated output.

8. Intellectual Property

The Preshift name, logo, and software are owned by Preshift and protected by applicable intellectual property laws. These Terms do not grant you any right to use Preshift’s trademarks or proprietary materials.

9. Disclaimers

The Service is provided “as is” and “as available” without warranties of any kind, express or implied. We do not warrant that the Service will be uninterrupted, error-free, or free of harmful components. Your use of the Service is at your own risk.

10. Limitation of Liability

To the maximum extent permitted by law, Preshift’s total liability to you for any claim arising from or related to the Service shall not exceed the amount you paid to Preshift in the 12 months preceding the claim. In no event shall Preshift be liable for indirect, incidental, special, consequential, or punitive damages.

11. Termination

We reserve the right to suspend or terminate your account at any time for violation of these Terms. You may terminate your account at any time by contacting info@preshift.me. Upon termination, your data will be retained for 30 days and then deleted, unless legally required to retain it longer.

12. Changes to Terms

We may update these Terms from time to time. We will notify you of material changes by email or by a notice in the Service. Continued use of the Service after changes take effect constitutes acceptance of the revised Terms.

13. Governing Law

These Terms are governed by the laws of the State of Georgia, United States, without regard to conflict of law principles. Any disputes shall be resolved in the courts of Fulton County, Georgia.
